Legal terms and conditions for our property management services
Coastal Estate Care - Terms of Service
Effective Date: July 15, 2025
These Terms of Service ("Terms") constitute a legally binding agreement between you ("Client," "Customer," or "you") and David Konetski ("Service Provider," "we," "us," or "our"), operating Coastal Estate Care as a sole proprietorship offering property management services in Rhode Island and surrounding areas. By using our services, accessing our website, or entering into a service agreement, you agree to be bound by these Terms.
If you do not agree to these Terms, you must not use our services or website. These Terms apply to all users of our services, including property owners, authorized representatives, and any third parties acting on behalf of property owners.
1. Definitions
- Client: Any individual or entity engaging the services of Coastal Estate Care.
- Service Provider: David Konetski, operating under the trade name Coastal Estate Care.
- Services: Any property management, inspection, coordination, or ancillary services provided by the Service Provider.
- Property: The real estate owned or controlled by the Client to which services are applied.
2. Description of Services
2.1 Monthly Retainer Packages
- Just the Basics ($500/month): Weekly home check-ins, visual inspection, mail collection, emergency contact, and monthly report.
- Standard Estate Monitoring ($1,500–$2,000/month): Full interior & exterior inspections, system & pest check, vendor coordination, mail/package management, and emergency response.
2.2 À La Carte Services
- Pre-arrival home setup: $300–$500/visit
- Vendor access & oversight: $165/hour
- Emergency site visit (after hours): $250/hour, $300 minimum
- Storm prep & post-storm inspection: $165/hour
- Seasonal home opening/closing: $1,000–$2,000
- One-time estate visit: $250
Customized services and schedules will be documented in individual service agreements or written addenda. We reserve the right to modify, suspend, or discontinue services with notice to clients.
3. Payment Terms and Billing
3.1 Payment Schedule
- Monthly retainer fees are due on the 1st of each month.
- À la carte services are invoiced upon completion and payable within fifteen (15) days.
- Late payments incur a 2% monthly late fee.
3.2 Billing Instructions
- Invoices sent via email to designated billing address.
- Accepted methods: check, ACH, or approved alternatives.
- Checks payable to: David Konetski.
- Include invoice number with all payments.
4. Property Access Authorization
Client grants David Konetski full authorization to access the property for inspections, vendor coordination, or emergency response. This includes scheduled check-ins, pre-arrival prep, storm inspections, and urgent issues.
David Konetski will provide advance notice when feasible but may access the property without notice in emergencies to prevent damage or risk.
Client affirms that they have the authority to grant access and are responsible for notifying any other occupants or stakeholders. The Client waives claims of unlawful entry so long as actions align with authorized services. All entry shall comply with Rhode Island laws.
5. Client Responsibilities and Obligations
5.1 Property Information and Access
Provide accurate information, including security codes, manuals, contacts, and instructions. Ensure property is accessible and permissions are in place.
5.2 Communication and Cooperation
Maintain responsive communication. Notify us of any changes to property access, service needs, or contact details.
6. Privacy and Data Protection
6.1 California Compliance
We comply with CCPA and CIPA. California clients have the right to know what data we collect and how it's used. No communication will be recorded without proper consent.
6.2 Rhode Island and General Privacy
We maintain strict confidentiality and adhere to federal and state privacy laws. Security measures are in place to protect your data.
7. Indemnification & Liability
Each party shall indemnify, defend, and hold harmless the other party and their agents from claims, damages, or expenses arising out of:
- Negligence or misconduct
- Damage by third-party contractors not hired by the Service Provider
- Client's failure to maintain insurance
- Legal violations by Client
7.1 Limitation of Liability
We are not liable for weather-related damage, acts of God, or system failures during gaps in service. Total liability shall not exceed 12 months of service fees preceding the claim.
7.2 Accidental Damage Clause
We are not responsible for minor, unintentional property damage occurring during good-faith service execution unless due to gross negligence.
7.3 Third-Party Vendors
We may coordinate third-party vendors, but are not liable for their actions unless negligently selected or supervised.
8. Insurance and Risk Management
We maintain liability insurance. Clients should maintain full property insurance including theft, liability, and damage. All services carry inherent risks, and we do not guarantee complete prevention of loss.
9. Force Majeure
Neither party shall be liable for delays due to uncontrollable events such as natural disasters, labor actions, civil unrest, or government interference.
10. Term and Termination
Service agreements begin on the start date and may be terminated by either party with 30 days' written notice. Immediate termination may occur due to non-payment, legal risk, or safety concerns. All access materials must be returned and outstanding balances paid at termination.
11. Dispute Resolution and Governing Law
11.1 Governing Law
These Terms shall be governed by Rhode Island law. California residents retain protections under California law.
11.2 Arbitration
Disputes will first be addressed in good faith. If unresolved after 30 days, matters may proceed to binding arbitration in Rhode Island under American Arbitration Association (AAA) rules, unless otherwise prohibited.
12. State-Specific Provisions
12.1 California Residents
You may:
- Cancel some contracts within 3 business days
- Exercise rights under CCPA and CIPA
- Be protected under California Business and Professions Code
12.2 Rhode Island Residents
You have rights under RI General Laws Title 6 and applicable consumer protection statutes.
12.3 Other States
Clients in other states retain their applicable consumer protection rights. State law shall prevail if more protective than these Terms.
13. Intellectual Property
All website content is the property of David Konetski and may not be copied or reused without permission. Reports and documentation created during services remain our property but may be used by the client for personal or property purposes.
14. Modifications to Terms
We may modify these Terms with 30 days' notice. Continued service use implies acceptance. Individual agreement modifications must be in writing and signed.
15. Severability
If any part of these Terms is found unenforceable, that part shall be modified or removed without affecting the rest.
16. Entire Agreement
These Terms, service agreements, and our Privacy Policy constitute the full agreement and supersede all prior discussions.
